Terms & Conditions
By hiring from Luxe Gown Boutique (LGB), you agree to these Terms & Conditions and our Privacy Policy. LGB may update these Terms at any time. Nothing in this agreement excludes any rights under the Australian Consumer Law.
1. Definitions
1a) "LGB", "we", "our", "us" means Luxe Gown Boutique or any authorised representative.
1b) "LGB Boutique" means any Luxe Gown Boutique location in Australia.
1c) "Client", "customer", "you", "your" includes the renter and/or the cardholder.
1d) "Garment" means any clothing item supplied on hire by LGB, including but not limited to gowns, dresses, and formalwear.
1e) "Event Date" means the date the Client intends to wear the Garment.
1f) "Hire Period" means the period from pickup/delivery to the scheduled return date.
1g) "Hire Fee" means the cost of the hire inclusive of GST.
1h) "Accessories" means any non-clothing items supplied on hire by LGB, including but not limited to jewellery, veils, belts, headpieces, and wraps. Unless otherwise stated, all Terms applying to Garments apply equally to Accessories.
2. Acceptance (General and Minors)
2a) You accept these Terms through:
• signature (electronic or physical)
• confirmation (electronic or physical)
• conduct (express or implied)
• any instruction reasonably interpreted as acceptance
2b) If more than one Client enters this agreement, all are jointly and severally liable.
2c) Once accepted, these Terms are binding and may only be amended in writing by LGB.
2d) Clients aged 13–17 warrant that a parent/guardian has reviewed these Terms.
3. Bond
3a) A bond is payable at the start of the Hire Period and refunded upon timely return of the Garment in acceptable condition at LGB's discretion.
3b) If the bond cannot be charged, the hire may not proceed, and the Hire Fee is non‑refundable.
3c) Bond amounts:
• $100 for Hire Fees under $250
• $200 for Hire Fees over $250
4. Freight / Express Post ($15 per direction)
4a) A $15 freight charge applies per direction for postal hires.
4b) If freight cannot be charged, the hire may not proceed.
4c) Tracking information is emailed upon dispatch.
4d) Clients must not remove the "signature on delivery" requirement.
4e) Returns must be lodged over the counter at Australia Post before 3pm on the first business day after the Event Date using the prepaid satchel provided.
5. Late Fees Policy
Luxe Gown Boutique relies on garments being dispatched and returned on schedule to ensure a seamless experience for all parties.
5a) Late Lodgement via Australia Post
If a hired item is not lodged with Australia Post within one business day (Monday–Saturday) after the rental end date, a late fee of $25 per day (plus applicable service fees) will be charged for each additional day until the item is lodged or returned.
Borrowers agree to this policy at the time of booking.
Late fees are capped at 14 days (excluding Sundays and public holidays) or up to 50% of the garment's RRP, whichever is greater, unless otherwise determined by Luxe Gown Boutique.
5b). Payment Collection & Outstanding Balances
Luxe Gown Boutique reserves the right to charge the credit card stored on your account or pursue any available method of collection if an item is returned late.
If payment cannot be processed, the Borrower agrees to remit the outstanding amount directly to Luxe Gown Boutique.
Unpaid invoices may be referred to a debt collection agency, and all associated recovery costs will be added to the outstanding balance.
5c). How Late Fees Are Calculated
Late fees are calculated from the hire end date until the exact date the item is lodged with Australia Post.
Borrowers will not be charged late fees for delays outside their control, such as verified Australia Post disruptions.
5e). Late Fees for Local Pick‑Up & Drop‑Off Orders
Items collected in person must be returned on the rental end date, unless both parties have agreed—in writing that the item will instead be returned by post.
If the item is not returned on the agreed date, late fees will apply.
To ensure transparency and protect both parties, all return arrangements must be confirmed in writing directly with Luxe Gown Boutique and retained for reference.
6. Cleaning / Alteration
LGB manages all cleaning.
Clients must not clean, press, alter, or repair any garment.
7. Title to Hired Garment / Risk
7a) Garments remain the property of LGB at all times. Risk transfers to the Client upon pickup/delivery.
7b) If a garment is lost, stolen, or damaged beyond repair, the Client must pay replacement value as determined by LGB.
8. Defects
8a) Clients must inspect the garment upon collection or within 12 hours of delivery and notify LGB of any issues.
8b) Garments may show fair wear and tear.
9. Changes / Cancellations by Client
9a) Hire Fees are strictly non‑refundable.
9b) To amend or cancel, email: info@luxegownboutique.com.au
9c) Hire‑credit may be issued if:
• In‑store pickup hires are cancelled 7+ days before the Event Date
• Postal hires are cancelled 14+ days before the Event Date
9d) Hires placed within these notice periods cannot be cancelled or amended.
9e) Hire‑credit is valid for 4 months.
9f) Hire‑credit cannot be split across multiple hires.
9g) Hire‑credit cannot be used for retail sales, bond, or freight.
9h) Once a new hire is placed using hire‑credit, it is final.
9i) Hire‑credit is non‑transferable.
10. Client Responsibilities
Clients must:
• notify LGB immediately of any damage
• not alter the garment
• avoid self‑tan within 48 hours (for light garments)
• keep the garment in their possession
• remove fashion tape before returning
• handle accessories with care; avoid contact with perfume, self-tan, or adhesives
• return accessories in their original packaging or pouch where provided
11. Cancellation by LGB
LGB may cancel a hire at any time before the Hire Period.
Only the Hire Fee will be refunded.
12. Default and Consequences
If the Client owes money, they indemnify LGB for all recovery costs.
LGB may repossess the garment or suspend services if obligations are breached.
A Garment that is not returned within 14 days of the scheduled return date, without prior written agreement from LGB, will be considered unreturned and may be reported to the relevant authorities as theft. All garments remain the property of Luxe Gown Boutique at all times. LGB reserves the right to pursue all available legal remedies to recover the garment or its full replacement value.
13. Security and Charge
The Client charges all rights and interests in any assets to secure performance of obligations under these Terms.
14. Intellectual Property Rights
Use of LGB services does not grant rights to any LGB content, branding, or materials.
15. Warranties and Disclaimers
LGB makes no warranties beyond those required by law.
16. Liability
To the maximum extent permitted by law, LGB is not liable for any direct or indirect loss.
17. Jurisdiction
These Terms are governed by the laws of Victoria, Australia.
